This exchange of goods and services are governed by certain rules of law. In the Malaysian context, the sale of goods is governed by the provisions of the Sale of Goods Act, 1957 (SOGA), the Contract Act, 1950 and the Consumer Protection Act, 1999 (CPA) (Yusoff et al., 2015). The sale of goods and services is done by way of sale contracts, which are similar to the other contracts and hence, the provisions of the Contract Act, 1950 shall be applicable in the sale of goods, as long as it is not inconsistent with the Contract Act, 1950 (Halim, 2014). The consumers, who buy goods from the sellers, have certain rights and obligations as the sale of goods is basically a contract between the seller and the buyer and these rights and obligations of the consumers are protected by the Consumer protection Act, 1999 (Nayak, 2015). Therefore, during the sale of goods, provisions of all the three acts shall appl y in relation to the rights, obligations, breach and remedies of the seller and the buyer in case of sale of goods. One of the issues that may arise in case of sale of goods is whether a refund will be available to a buyer in case of any damage found after purchase, where the seller in such case has provided a disclaimer. The collaborating paragraphs will discuss this issue under the various provisions of the three Acts, relating to the sale of goods, in the Malaysian context. Discussion In the sale of goods, a common problem arises regarding the right of the buyers to claim refund in case of disclaimers for the sale of goods by vendors. A disclaimer in law generally means statements that specifies or restricts the scope of the rights, and obligations that is otherwise enforced and exercised by the parties within a legally recognized relationship (Whaley McJohn, 2016). However, in the legal context, unlike the other terms, the term disclaimer usually relates to situations that involve a level of risk, waiver or uncertainty. A disclaimer can specifically mention the terms and conditions of a contract agreed mutually or it can also specify exceptions or warnings in order to qualify a duty of care, owed to prevent the unreasonable risk of injury or harm. On the other hand, some disclaimers are proposed for limiting the causation of damages, after any harm has been sustained. In addition, some disclaimers are used as a voluntary waiver of right or obligation that is owed by the disclaimant (Armstrong et al., 2015). Disclaimers are not uniform and may differ depending on the parties and the particular context, while other sort of disclaimers may stick to a consistent and established set of formalities, which are subjected to rare or negligent modification, except under authorized authority. The presence of a disclaimer does not essentially mean or assure that the terms of disclaimer will be enforceable and recognizable in any statutory dispute. Other legal considerations may be there for rendering a disclaim er to be void either in whole or in part. A disclaimer in a contract for sale usually states that a the seller will not be responsible for any defect in the goods, after purchase and the buyer shall have no right to refund of the purchase amount (Green, 2014). Whether such refund is possible or not can be defined by interpreting the various provisions relating to disclaimer, under the three abovementioned Acts. Laws related to disclaimer In case of the sale contracts, as stated above, one of the main issues is when a seller or vendor puts up a disclaimer on the goods of sale. Disclaimer on the sale of goods means that in case of any defects found in the goods after purchase, the buyer shall not be entitled to claim a refund from the seller or vendor. The issue is whether it is still possible for the buyer to claim the refund from the vendor. In Malaysia, disclaimer and limitation of warranties clauses are more commonly referred to as exemption or exclusion clauses (Karim, 2016). The Malaysian law does not a draw a difference between the two clauses. Until the CPA, 1999 came into force, there were a very few statutory provisions for limitation of liabilities clauses. Section-29 of the Contract Act, 1950 and section-62 of the SOGA 1957 also deal with the provisions relating to the disclaimers and limitation of liability clauses in case of a contract for sale of goods (Nayak, 2015). Disclaimer and limited liability clause under the Sale of Goods Act, 1957 (SOGA) According to section- 62 of the SOGA 1957, any right, duty or liability, arising under a contract of sale, which may be implied by law, can be waived adversely or varied by an express agreement. However, such waiver must be made during the course of dealing between the parties or by usage, in the case where such usage is to bind the parties to the contract (Tehrani Manap, 2014). Therefore, according to this section, when a vendor puts up a disclaimer in the contract of sale, the buyer cannot claim any refund for any damage found in the goods after purchase, as such disclaimer is an expressed agreement according to section 62 of the SOGA. Section- 62 of the SOGA clearly recognizes the rights of the parties to change or vary the ordinary incidence of a contract by way of expressed terms for measuring the damages in case of breach of contract and also for excluding any conditions and terms that the law attaches to the contract of sale of goods (Razman, 2014). However, the SOGA also states that such expressed agreement in a contract of sale must also be signed by both the parties. If an expressed agreement term for the condition of breach is not signed, then it shall not be enforceable and will not apply. The law of disclaimer limited liability clause under the Contract Act, 1950 In Contract Act, 1950, under section- 29, a party to an agreement is restricted absolutely to exercise or enforce his rights under or in respect if any contract. The party is subjected to normal legal proceedings in the ordinary tribunals. The party must enforce such rights within the stipulated time; otherwise, such rights shall be rendered as void or invalid to that extent. This law under the Contract Act, 1950, again, clearly empowers the parties to contractually limit or exclude the liability by stating it expressly in the contract. However, as stated earlier, such express agreement shall not be enforceable if it has not been signed. However, it is still possible to limit and or exclude liability if the liability exclusion terms were incorporated in the agreement between the parties, for protection of the party, who seeks to rely on the clause (Zawawi Alias, 2016). Moreover, the person against whom the exclusion clause had been incorporated must have the knowledge of such clause. As the law provides for expressly limiting the liability under a contract, the scope of applicability of such exclusion shall is very wide and it is so wide that, if correctly worded, it can even waive the liability for negligence. In Malaysian Airlines System Bhd. V Malini Nathan and Anor.[1986] 1 MLJ 330 the passengers were confirmed and booked on a flight. The airline ticket contained a printed contract which stated that the carrier would make best efforts to carry the passengers and assured that the luggage will be dispatched accordingly. It was expressly mentioned in the contract that the time and other places shown on the timetable was not guaranteed and did not form a part of the contract. In addition, it stated that the carrier might substitute alternate carriers or aircraft and might cancel or alter the places of stopping, mentioned in the ticket. It also mentioned that the schedules were subjected to change without notice. Later, the flight was overbooked and it became impossible for the respondents to accommodate on the flight. In this case, the Supreme Court held that the respondents were not entitled to claim damages from the airlines, as the airline was not in breach of contract, as they could rely on the exclusion clause. However, the contract that involve consumers, are given statutory protection and the extent of the limitation of liability has been severely restricted by the Consumer Protection Act, 1999. Disclaimer and limited liability clause under Consumer Protection Act, 1999 In Malaysia, the Consumer Protection Act, 1999 is the most important and the main legislation that protects the consumers in Malaysia. The CPA has been influenced by legal developments in Australia, UK, Canada and New Zealand. In Malaysia, this Act safeguards the consumers from the sellers by eliminating unfair contract terms regarding exclusion clauses. Part-III of the CPA, which is a new addition to the CPA 1999 by amendment in 2010, specifically deals with the unfair terms in a consumer contract by dividing unfairness into procedural and substantive unfair. Section 24C of the Act, procedural unfairness means unfairness in the making of a contract like the failure of a party to notice a contract term during small printing at the time of signing (Latimer, 2016). On the other hand, according to section-24D (1) states that a contract is substantively unfair, if the contract terms excludes or restricts liability for negligence or liability for breach of implied or express terms of the contract without proper justification in case it involves oppressive, harsh and unconscionable terms. This new law has covered liability exclusion for both the tort of negligence and contractual obligation. According to section-24(G) of the Act, the court or Tribunal can declare a contract term to be unfair under section- 24C and 24D of the CPA to be void or unenforceable (Jackson, 2014). Moreover, the CPA 1999 faced criticism on the ground that it was not applicable for commercial contracts. But the amended Act of 2010 made it applicable to all contracts as well. In the case of Saad Marwi v Chan Hwan Hua Anor [2001] 3 CLJ 98 the judge was of the view that it was time for the courts to recognize the wider doctrine of inequality of bargaining power for doing justice. In this case, stress was given by the court on the provisions in Part-III of the CPA. In this case, it was recognized that in the presence of an expressed exclusion of liability clause in a consumer contract, it could be made void and unenforceable by the court under Section- 24(G) of the Act, by raising questions regarding the fairness of the contract terms stipulated under sections- section- 24C and 24D of the CPA. Furthermore, the Act also provides that if a contract includes expressed terms, which are unfair according to the law, it shall not be enforceable as was also determined in the given case. Conclusion Therefore, it can be stated that concerning the issue regarding the possibility to obtain refund from a vendor, in case of a sale contract, which includes a disclaimer regarding the liabilities of the contract, the Contract Act, 1950 is silent on the matter and does not provide anything specifically on this regard. The Sale of goods Act, 1957, although states a little about the exclusion clause in a contract under section-62 of the Act, it does not clearly provide any solution as to the remedy to the buyers. However, it is the Consumer Act, 1999 and its Amendment in 2010, that, by the provisions in its part III, clearly provides remedies in case of unfair disclaimer terms in a sale contract. Therefore, refund will be available to the buyer despite of the vendor putting up disclaimer, under the CPA, when the terms of such exclusion clauses are unfair. However, in certain cases it can be observed that entities are sometimes liable for the actions of any other person acting as an agent in the absence of any formal appointment. In this report the duties of various agents to its principal has been emphasized. It is noteworthy to mention here that different agents have distinct duties towards their entities however it is important that agents should be appointed formally in order to get relief under the provisions of Section 135 to 191 of the Contracts Act 1950 (Bakar, 2013). The principal is bound by the acts of an agent if the acts are performed within the authority of the principal. The acts done by the agent beyond such authority do not bind the principal unless the principal approves the unauthorized act. In this report, emphasis has been laid on the relationship betwee n agent and his principle and the acts performed by the agents in the boundary of such relationship. Discussion Creation of Agency An agency can be defined as the relation between an agent and a principal in whom the function of the agent is the creation of contracts between the principal and the third parties according to the provisions of Section 135 of the Contracts Act 1950 (Balasingam, 2017). The Part X of the Contracts Act 195 governs the provisions of the law of agency. There had been a confusion regarding the concept of agency that it is a relationship between the principal and the agent since time immemorial (Ishan Abdullah, 2015). However, agency is in fact a tri parte relationship between the agent and his principal and third party. According to the provisions of Section 136 of the Contracts Act 1950, a person under 18 years and of unsound mind can be considered as an agent however they are not liable for their acts done on behalf of their principal (Alibeigi Munir, 2016). In this regard the provisions of Section 138 of the Contract Act 1950 set out the conditions for the creation of agency. In KGN Jaya Sdn Bhd v Pan Reliance Sdn Bhd it was held that the contract of agency should not necessarily be in writing, it can be expressed or implied. An agency can be created by the express appointment by the principal and in such cases the principal shall not be liable if the agent exceeds its authority. The agent shall be liable personally to the third parties for the breach of his authority. According to Section 140 of the Contracts Act 1950, an agency can be created by both express and implied appointment (Tehrani Manap, 2014). An agency can be created by implied appointment when the principal in his own words or conduct has given the authority to a third party to act for him. In Chan Yin Tee v William Jacks and Co, it was observed that the plaintiff agreed to supply goods to the defendants believing him to be the partner of another person. The defendant in this case did not pay the payment of the goods delivered, as he did not know the commerce of business. The plaintiff sued the defendants for not providing the payment of the goods. The court in this case held the defendants to be liable as they were a part of the contract and cannot in any way repudiate from such contract. In this regard it can be stated that agency can also arise as a result of necessity when the agent has acted in good faith, when it became impossible on the part of the agent to follow the instructions of the principle and when the action of the agent was necessary to prevent the loss of the principal. In SRM Meyappa Chettiar v Lim Lian Koo it has been observed that Palaniappa Chettiar the attorney of Somasundaram Chettiar entered into an agreement with the defendant where Palaniappa Chettiar handed over a piece of land to defendant which belonged to his principal for a sum of RM 7000. However, it was seen that such sum was to be returned to the de fendant who was ratified by Somasundaram Chettiar. The Court of Appeal held that Palaniappa Chettiar was acting in his personal capacity as per the terms of the agreement. The Court held that the principle of ratification would not apply in case of this agreement held it. The extent to which entities or principal are liable for the activities of the agent According to modern jurists the acts of the agents are binding upon the principal and thereby the acts are done in such authority. However, it is important to have a knowledge regarding the nature of the authority of the agent. The extent of the authority of the agent authority has been defined in the provisions of Section 141 of the Contracts Act 1950 (Mahmood, 2013).An agents authority can be categorized into apparent authority and actual authority as depicted in the provisions of Section 141 of the Contracts Act 1950. The authority given by the principal to its agents either in writing or orally is termed as actual authority. The concept of actual authority can be explained with the help of a Malaysian case Firm of T.AR. CT. V. SV. KR where it was held by the Privy Council that an agent is authorized to be aloof from the money matters of the firm and has the implied authority to receive repayment for the benefit of the firm. In a recent case Tunku Ismail, bin Tunku Md. Jewa Anor. V. Tetuan Hisham, Sobri and Kadir the plaintiff was the authorities of an estate and was involved in the selling of a piece of land for more than one million. The respondents were the solicitors acting on behalf of the bank and the purchaser. The Court held that the burden of proof of apparent or ostensible authority lies with the plaintiffs. In this regard, the Court held that there could be only apparent authority in order to give such an undertaking and the solicitor had such authority in the ordinary course of business. It was a necessary part of the undertaking to pay the balance of the purchase price to the plaintiffs in order to complete the registration process undertaken by the defendants as solicitors representing the bank, successfully. According to section 141 of the Contract Act 1950, the concept of apparent authority can be explained. As per section 141 of the Contract Act 1950, an apparent authority may arise when the principal either expressly or impliedly permits a third party to act as an agent (Apandi Bolhil, 2016). According to the provisions of section 141 of the Contracts Act 1950 an apparent authority can also arise in cases where an agent previously had the authority to conduct on behalf of the principal without acknowledging the third party (Bakar, 2013) terminated such authority. In Graphic Lines Pte Ltd v. Chai Chee Mein Ors it was held by the Court that the respondents who were partners of the night club were bound by the acts of the assistant manager who participated in the advertisement for the nightclub along with the partners. The general manager had acknowledged the plaintiffs that such advertisements shall take place through the assistant manager. In this case, the general manger had actual authority to decide whether the assistant manager shall place the advertisements on behalf of the club; hence, the defendants were bound by such act. The Court concluded that in this case, the assistant manager had the apparent authority. Duties of the agents to counterbalance the principals liability caused by their actions For the purpose of counter-balance to the potential exposure and liability of the principal caused as a result of the actions of his agent, the agent in this regard owes certain duties to the principal in common law and equity. In this regard, it can be stated that an aged owes certain duties to the principal that could be contractual, commercial and fiduciary in nature. According to the provisions of Section 164 of the Contracts Act 1950 the agent is obligated to conduct business of the principal. However the agent is obligated not to misuse his position (Lambak Tahir, 2013). The agent has a duty to disclose the material facts to his principal in order to avoid conflict of interests in future. According to the provisions of Section 168 of the Contracts Act 1950 an agent is prohibited from making any secret profit from any third party (Alibeigi Munir, 2016). On receiving secret profit from any third party the law of land presumes it to be secret commission or an act of bribery. In such cases the principal has the opportunity to repudiate the contract if it occurs to him that such secret profit made by the principal will be disadvantageous to him. However in this regard, if the agent deals with the business n his own account then the principal do not have the authority to repudiate the contract in case of any secret commission made by the agent. The burden of proof lies on the principal and he needs to prove that relevant facts and materials had been hidden by the agent in order to gain secret profit from the principals business. The principal is entitled to recover secret profit made by the agent in the business transaction in which the agent sold the materials at a higher price, which was previously set by the principal. In case the agent passes the secret profit to a third party, the principal has the right to recover the same. In Tan Kiong Hwa v. Andrew S.H. Chongit was held by the Court that the principal is entitled to recover a sum of $ 9,000 from the agent as the agent has breached his duty. In Mahesan v. Malaysian Govt. Officers Co-operative Housing Society Ltd it was held by the Privy Council that the defendant is entitled to recover the bribe and the actual amount of loss suffered by him. Conclusion To conclude, it can be stated that an agency can be created with the help of express and implied appointment by the principal. However, in certain cases without prior appointment, an agent causes breach of his duties to the principal for which the principal becomes liable. In certain cases, the principal cannot be held liable for the activities of the agent if the agent acts in good faith and due diligence. In some cases, it can be observed that if the breach of the agents duties exceeded overtime then the principal is at the authority to repudiate the contract. Also, in contrast to the sheep, he views the girls as though they are superior to everyone else in the store. They stand out amongst the customers, walking against the usual traffic(Updike 616), and not blending in, and Sammy almost idolizes that; he sees the way their simplistic yet unique appearance and actions distinguish them and he seems to really appreciate it. When Sammy sees the store manager, Lengel, embarrass the girls, not only does Sammy see the ability to look heroic in front of his three mystery girls, like an unsuspected hero (Updike 618), he also sees the ability to get out of his boring nine to five job. Partially, because he is only nineteen and very immature in the way he views the world, he may have thought the girls would find him heroic. However, as soon as he quits his job he realizes that they didnt seem to care; it was just a silly childish fantasy he hoped would come true. After leaving the store, Sammy says I look around for my girls, but theyre gone of course (Updike 619) as though he knew from the beginning that although in his mind it may have seemed like something worth praise, they really wouldnt care at all. However, Sammyââ¬â¢s quit is more for himself that the girls in the long run, after all if it was really for the girls he wouldve ceased quitting the moment the girls rushed out and flicker[ed] across the lot to their car (Updike 618). But it seems to me that once you begin a gesture its fatal not to go through with it. (Updike 618). Even though he knows this will be difficult for his family he continues to quit. On one hand, he is being mature by not backing down and changing his mind once he realizes the girls are gone, because he is right in that when you make decisions you must follow through with them. However the decision to quit was stupid, drastic, and an immature one to begin with. The story ends with Sammy looking back at Lengel in the store, saying His face was dark gray and his back stiff, as if hed just had an injection of iron, and my stomach kind of fell as I felt how hard the world was going to be to me hereafter (Updike 619). The dark and unappealing imagery he uses to portray Lengel and the store hints that he still views it negatively and he is most likely content with his decision to leave. However he ends realizing how much damage this silly impulse can and will cause him. This may be a lesson for Sammy in which he learns from and gains some maturity; he learns that there are consequences and positives to every situation and it is his responsibility to deal with them as they arise. In this particular situation, although he is happy to not be in his job, he now has to deal with telling his parents he quit and telling them why he made such a rash decision. Then he must deal with their feelings on the matter and what actions they take; they may not care, or its possible, as the story and Lengel suggest, that they will be upset and he will have to deal with that. Regardless, he will definitely learn from this. There are also social, economic and environmental risks associated with these industries which affect men and women differently. Research by the World Bank (2009) has indicated that men have the most access to the benefits of these industries, whilst women are more likely to suffer the consequences of the social and environmental harms associated therewith. The different experiences of men and women in these industries significantly affect the ability of women to contribute to active growth and development in their respective economies. The gender gap in the oil and gas industry exists in two separate forms, the first being the top-end employment discrimination where there is a lack of females at the higher end of the employment spectrum seeing very low numbers of female engineers, and science and technology employees (European Com mission, 2009). On the one hand this problem is a reflection of the imbalance of opportunities for adequate education, and on the other is what is referred to as the ââ¬Ëleaky pipelineââ¬â¢ conundrum which describes the phenomenon of disproportionate numbers of women leaving these professions in each consecutive career stage in this industry. The second form of the gender gap is the very low numbers of female employees at the bottom end of the employment spectrum, that which requires lower education standards, but which may be more physically intensive. The World Bank reports (2009) that in most companies there is a female workforce of less than 10%, as these types of jobs are generally considered to be a ââ¬Ëmanââ¬â¢s jobââ¬â¢. This is so because of the inherent physicality required in these work environments and the exposure to chemicals which presents a problem for female employees that are pregnant, meaning more time away from work and the inability to work if pre gnant. There is an argument to be made either way, with diversity goals becoming a secondary concern in favour of productivity and outcome. Male workers often have had greater educational opportunities and therefore less training and education is required, as well as less concern for factors of work-life balance. In the current economic climate, cost effective labour solutions are being of primary importance, particularly considering the growing importance of labour standards and quality of work environments which also present greater cost implications. On the other hand, studies have shown that in employment that is non-physical in nature women perform more productively and effectively, coupled with the barrier to private sector growth and development that employment discrimination breeds, increased female representation in the oil and gas sector may prove to be a more economical labour practice. Human Resource Management: This area involves development of a human resource plan which is done in the planning stage and execution of the same by acquiring project team, developing the team, and managing the same(Belout Gauvreau, 2004). Part 2 In this part, a few cases of large projects are taken as a base for understanding the importance and value creation in terms of human resource management and risk management. Human Resource Management Human resource management is essential on a project as the project performance largely depends on the people working for it. Projects can survive only when they have clarity of vision, strong work culture, and skilled workforce. Thus, reaching project goals require focus on human factors(Boudreau, 1996). It is an important part of any project management and it involves determination of competency and skill requirements of projects, assessment of potential candidates based on the same, selection and recruitment of right resources and their management. For any organization to be able to do that, the first step is to hire an efficient project manager who would the take care of the plan for the acquisition and use of other resources(Mishra, 2007). Inefficient HRM in Sydney Opera House Sydney opera house was the first construction project that used Computer Aided Design. The project was in major limelight for its unique design but from project management point of view, it is largely considered as a failure due to two main reasons. First, the project exceeded its original budget by a large amount. While the initial budget allocated was only AUS $1 million, the actual project cost $102 million. The construction work was also much delayed as the final design of the project was completed 4 years after the construction had already started. In the Sydney Opera House Project, there was no project manager involved but the designer Utzon himself was expected to take coordinate all activities. However, Utzon did not have any practical experience of such large construction projects because of which designs and implementation methods kept on changing and many a times, already build structures were demolished and rebuilt. The original design of roof which had made Utzon won the competition was under major controversy as it was later found not feasible and thus, Utzon revised its design. If the project had an experienced project manager handling coordination and execution activities, Utzon did not have to divert from his design work(Sanchez, et al., 2015). Moreover, there was no human resource management plan made but management of the construction project team was left to Utzon who was a good at aesthetics of designs but was not an adept manager. He would not listen to the concerns and suggestions of engineers but was only concerned about the aesthetics of the roof. This resulted into conflicts and delays. Because of the delays, people started to leave the project which resulted into high turnover(Ballesty, 2005). Effective HRM in DLC In the infrastructure construction project of Dubai Logistics City (DLC), management knew well in advance that capacity would be a constraint for such a large project to handle as contractors, skilled engineers, logistics and project management professionals were not available sufficiently with the government. However, with proper human resource planning, the management of the project took a different approach to human resource and took some professionals from the private sector. While taking people from private sector, they also realized that they had to do some modifications in contract arrangements to attract them as well as keep the workforce satisfied and motivated. Thus, strategies were adopted to curb quality issues and overcome constraints of supply chain. Some of these strategies included advanced payment structure and the promise of largest price that were adopted over the traditional mode of payment after work and fixed contract pricing(Sen, et al., 2007). Risk Management The process of risk management begins at the time of project planning such that probable risks are identified and response plan is created to manage them at the time of occurrence. If risks are not evaluated in advance then it becomes difficult to respond to them fast when they actually occur. Moreover, certain risks are likely to affect project to a major extent. Such was the case with the opera house. The risk of using a design that was made out of lack of practical experiences of construction project could have risked instability and lack of construction feasibility which was not evaluated before the project was planned. This resulted into selection of a design that was good as per looks but was not feasible for construction. Lack of Risk Management in Opera House The Opera House project had many risks and uncertainties that affected its performance but the same were not forecasted at the time of planning. From the starting of the project itself when a design competition was conducted to call designs for the construction of opera house, no clear evaluation was done on the past experience of the designers with construction projects. Various risks and uncertainties that were not accounted for in planning but cause major impacts on the project included: Impractical design: The design made by Utzon, the chosen designer was not practical for construction because of which he had to make major changes in the design and the final design was only completed after 4 years of the start of the construction work. Conflict due to change in Stakeholder expectations: The expectation of Australian government from the project was not made clear at the start nor was any consideration made for risk of inability to meet the expectations. The original design was created considering two theatres but later government officials demanded 4 theatres. Cost Conflicts: Initially, the government gave a go ahead for no limits on funding but at the later stages of the project, when the expenses exceed beyond expectations, limits were put on funding which lead to frustration and discouragement in the project team. The initial estimates of project cost were highly superficial that did not work with the project activities and thus, there was a need of more funding. By the time, government realized this and increased the funding in 1966; Utzon had already left the project. Loss of Human Resource: Utzon left the project in the middle of construction because of discouragement from lack of funding. New designer was to be hired and as Utzon took away his ideas as well, a new design was to be developed by the new designer. This rework escalated the cost to a large extent and the project ended up spending AUS $102 million by the end of the project. Risk Management in Sydney Cross City Tunnel Project Sydney Cross City Tunnel Project was an outcome of a Public Private Partnership which needed division of responsibilities as well as risks between the two entities . However, all the risks were offloaded to the private player while government agency only provided initial funds required for project. Private organization was unable to manage the risks well. It faltered specifically in the management of financial risks(GAMUT, 2014). The project reflects the importance of not only recognizing the risks but also in recognizing appropriate people or entities who should take the responsibility of managing the risks. Moreover, the project lacked a systematic risk management methodology that could have been agreed upon mutually such risk response plans could have been identified and appropriate risk policies could have been set. It was only after all the funds were exhausted and the project was making losses that the lacuna was realized and the government came up with a new arrangement in which risks were properly planned and shared between the two entities(Chan, et al., 2008). Part 3 Human Resource Management Use of human resource management strategies and tools defined in the project management methodology can add value to the project in following ways: Responsibility assignment matrix ensures that every work package is properly assigned to qualified team member which avoids role related conflicts(NCKU, 2008). RACI matrix can be used to identify if a person is given responsibility but lack accountability which can cause conflicts of interest. If this was used in the Opera House project, a realization could have made that Utzon who was given responsibility of managing project was actually not accountable for it and thus, could decide to leave the project exercising his freedom. On the other side engineers were given responsibility to take care of technicalities of the project but were not given authority to take decisions such that only Utzon decided what was to be done which again resulted into people conflicts and loss of interest in engineers. Human resource plan also takes care of the competencies of people such that they are hired on the job only when they have the right skills for managing a part of the project. In case of the Opera house project, Utzon was expected to manage people which required project management skills that were not present in him. A human resource plan helps management clearly identify staff requirements, cost estimations for resources, when resources are needed, required skills, training requirements and equipments required by staff. This clear identification of resource requirements can help resolve resource conflicts as well as ensure that they posses right skills and competencies to be able to complete the project with proficiency(Mishra, 2007). Risk Management A risk management planning can add value to the project as it is a proactive process for managing risks such that risks that have not occurred but can be expected are analyzed in advance and a plan is developed for responding to them as they occur. Risk management process also help managers identify the likelihood of each risk and the impacts they can cause on the project such that appropriate control strategy or response strategy can be developed. For instance, if there are risks found that can create major impacts on the project performance but if identified earlier, they can actually be avoided from happening; an appropriate measure would be taken to already eliminate the risk even before the same occurs. For instance, in the case of opera house project, if a risk of presenting a design which was not practical was realized at the start of the project, a requirement of having an experience with large scale construction project could have been added in the competition which could have resulted into applications of only those designers who also know the practical challenges of construction such that the design presented was sustainable. In the same way, if the risk of Utzon leaving the project in between was identified earlier, company would have already taken the designs and other work done by Utzon in their custody such that even if he left the project, the same designs could have been used by the new designer and new design would not have to be created. This way, a huge loss to the organization could have been prevented that was causes because of redesigning and reconstruction of the project. Conclusions Recommendations This report was prepared to understand how project management practices can add value to projects. For this, a case of Sydney Opera house project was taken which was explored against the practiced of human resource management and risk management used. The base of Project Management Body of Knowledge was taken for analysing the case. The report presented the arguments on the statement, With respect to managing projects, the Project Manager is constantly required to monitor progress, gather information and problem-solve to make decisions The report identified ways human resource management and risk management added value to projects. Based on this study certain recommendations can be made: Human resource management should include clear identification of roles, responsibilities, skills, competencies, and training requirements. A person made responsible for an activity must also be given required authority to be able to take decisions A person made responsible for something must also have an accountability for the same to be able to expect sincerity from the person All possible risks on the project must be identified and those that can be avoided must be avoided. Critical reflection is taught in various professional fields, including the health care system. This concept is not just theoretical but requires practical applicability also. Theoretically there are three models for reflecting critically. The first is the Deweyââ¬â¢s model of reflective learning which advocates that knowledge can be obtained by relating the past and present experiences. This approach is referred to as the pragmatic approach. The second model is that of Habermasââ¬â¢, which ad vocates the critical theory behind this approach and demonstrates three areas of knowledge, namely, practical, technical and emancipator. AIM AND OBJECTIVE The objective of this paper is to critically examine and reflect on my professional skills and performance as a registered nurse, in the domain of adaptation of practice. DESCRIPTION The initial period of working in any professional field is very difficult and tiring. When I started to work as a nurse, in the emergency, I used to work for 6 days a week. The timings were also very stringent, from 8.00 AM till 3.00 PM. The work load was much higher as compared to the task force available. The number of nurses was reduced considerably and the health staff was under continuous stress as they had to cater to so many patients. Another problem faced by the health staff was the duration of stay of the patients and the workload on the emergency section. In my country, general statistics show that patients stayed for minimum two days. With each nurse catering to 6-7 patients at one time, it is nearly impossible to pay adequate attention to each on simultaneously. Plus this increases the work load to a greater extent. Most of the nurses, who worked, just had a diploma in nursing, while I and two others had the bachelorââ¬â¢s degree. This is what distinguished us. We had better theoretical as well as practical skills as compared to them. This plus point kind of added to the workload I had. I was made responsible for all the emergency situations and for looking after the patients who were brought in emergency conditions. One of the main procedures of emergency is suturing. Since suturing requires both practical as well as theoretical skills, I was the one who was given the task of suturing, assessing the wounds of the injured, examining any other damage like that to arteries or tendons or nerve fibers. The morning task was to review all the patients along with the doctors and then for the latter half of the day each nurse was assigned 6 to 7 patients to take care of. OVERVIEW OF CRITICAL REFLECTION Nursing literature frequently mentions about critical reflection but nowhere has this term been defined precisely (McBrien, 2007). The new energy within will help in challenging the beliefs and assumption, that already exist and lead to better understanding of the things and thereby bringing about a change for benefit of all. Because of the increase in expectation from the nurses, they face complex demands, change and higher accountability. SchÃâà §n (1983) has put forward two major reflections: reflection in action (which occurs when the action is being performed and is a result of thinking critically) and reflection on action (which is reflected after the action has been performed). Reflection in action involves many skills like being a good observer in every situation and trying to learn something out of every situation, interpreting, recording and understanding your feelings and responses to a certain situation and then inter relating your previous experiences, always make yourself counted in the experience via taking a ââ¬Ë witnessââ¬â¢ stance. On the other hand reflection on action is the most common form of reflection as what you have learnt or understood from your past encounters, all reflects in your future actions (David Somerville, 2004). The domain of interest here is the domain of ââ¬Ëadapting practiceââ¬â¢. It contains the competency abilities of advanced registered nurses to comply with and adjust or adapt to the challenging and more complex situations and still yield in better outcomes in terms of services offered (Australian Nursing Federation, 2005). The standards that are set, help in encouraging post graduate education for development in the field of advanced nursing practices and also enable each individual to individually critically analyze their competency in different domains (McGee, 2009). Like every other domain, the domain of adapting pr actice also stresses on understanding and meeting the needs and requirements of the patients who are suffering from complex and critical conditions (competency standard 4). FEELINGS AND THOUGHTS Adaptation to a new environment is extremely difficult and it takes lots of patience and practice to adapt comfortably. I face many challenges in my workplace and earlier found it difficult to adapt. I also felt embarrassed when I needed help and could not ask anybody, fearing that my reputation would go down and that my fellow colleagues would make fun of me. Being equipped with the interpersonal skills, theoretical as well as practical knowledge about taking care of the patients and delivering the best quality of service, enabled me to climb up the ladder of success. Even though earlier it was difficult for me to interact with my fellow colleagues, now I can converse comfortably with anyone including my colleagues, patient, families and other staff members. Most of this was the result of feedback which I received from the patients, who generally praised my ability to empathize with the patients and then cater to their needs. As quoted above, feedback is an essential component for c ritical reflection, the positive feedback that I received from the consumers and my fellow staff members helped me visualize things with a different approach. I started enjoying my work. There were situations when I feared the outcome of some medical action. In my country, there are no rules and regulations pertaining to the safety of the health care professionals. This causes safety issues with the carers. Even I found myself in such situation when the medical practices could not save the life of the patient and his family members were outrageous, blaming the hospital for their loss, intending to burn down the entire building and take revenge. But then one should not be afraid of shadows, as shadows mean there is light somewhere near. There is an instance that reminds me of my good work and better performance as a nurse. I once cared for a boy who had been stabbed in the abdomen. There was profuse bleeding and I had taken every possible measure to stop the blood flow and restore th e consciousness of the boy. Three weeks later, that same boy came with his parents and thanked me for saving his life. Such precious compliments and gratitudeââ¬â¢s count a lot in the long run. EVALUATION I realized that during my performance in the hospital, as a registered nurse, I had some positive as well as negative traits. Good command over English language was counted among my positive traits. This enabled me to quickly read and understand the nursing articles written in English. Also since I could understand and associate what was mentioned, I was able to deliver effective care to the patients. Also my expertise in the fields of pathophysiology and emergency skills made me an important person in the hospital. Whenever there was a case of any emergency, I was made responsible to monitor the patient and do the needful. On the contrary, the nurses who lacked the knowledge about emergency skills or were not fluent in English language missed the opportunity. Ching Ying Lee (1998) has reported that nursing practice requires knowledge of proficient English as the nurses should be capable of using medical terms in fluent English. English is the most common language spoken worldwide and therefore, such a language should be known by all in order to address the cross cultural barriers in health care. Not only English is a common language but it has been named as the scientific language worldwide. Therefore, it is essential that all the communications pertaining to the medical condition of the patient, the health care outcomes and the treatment be explained in English to the patient as well as the concerned members (Mylaeus Renggli MI 1998). Another positive point that added to my portfolio was the good interpersonal and communication skills. With these skills I was able to interact efficiently with the staff and the patients as well. In order to deliver better services I followed the rule of empathy. Whenever any new patient was put under my care, I listened to him/ her and tried to picture myself in her/ his situation, so that I can understand better about the current situation of the patient and accordingly provide the guidelines to the family and the other medical staff. Most frequently we were faced with situations in which the burden on the health care unit was so much that all the patients were not being given equal attention, due to lack of task force and increased number of patients. In such cases one or the other patient or the family member would stand and start shouting in anger. I helped in controlling many such situations by calmly making the individual understand our plight and thereby promising him that I will take care of his/ her family member as soon as I get free. I utilized my good communication skills to deal with such patients. It is very important to have good communication skills in order to build trust between the patient and the doctor. It will consequently allow or enable the patient to disclose the information which might prove fruitful. Good communication also motivates the patient to get involved in the decisions related to health care, minimizes the risk of mishaps and errors and eventually enhances the satisfaction level of the patient (NHMRC, 2004). Literature has also shown the importance of understanding the cultural beliefs of the patients and making more accurate and meaningful decisions that are appreciated by the patient and the family both (Lawrence Dyche, 2007). Another important learning from my experience was that knowledge is never enough. Even after being a Bachelorââ¬â¢s degree holder, I found myself lagging behind in the field of pharmacology. Thus, it became the need of the hour for me to undergo a special three months training in this field and then I was all set and comfortable in explaining the patients about different drugs and their prescriptions. Although it is not advisable for the nurses to get into doctorââ¬â¢s role and prescribe drugs t the patients but they should know what different drugs are meant for, so that if the patient has a query related to which drug is administered to him or why it is administered, they should be able to answer them with confidence (Clare Lomas, 2010). One of the negative traits that I discovered within myself was not being able to extract the medical history of the patient. Emergency nurses should possess the skills of physical assessment as well as health history. This lag can be attributed to the overburden and work overload during the emergency situations. Another reason can be the demand for nurses as there had been shortage of nurses since of long time in my hospital. This is important because a track record of all the details about the illness that have been occurring in the family can help in predicting the prognosis of the current state of the patient. Another negative quality that I possessed was lack of team spirit. Whenever I had many patients and was overloaded with work, even though I wanted someone to help me, yet I never asked for help. I am now able to realize that team work is essential for efficient working of the team as it enables us to learn something new and benefit from each of the members involved. ANALYSIS My experience, expectations, feedback and results have majorly influenced the knowledge I have gained so far. My skills like being able to communicate proficiently in English and being able to understand the text presented in medical journals, which are generally written in English, has helped me gain recognition and my work has been appreciated by the authorities as well. SYNTHESIS RECOMMENDATION FOR FUTURE PRACTICE I feel that I have precisely highlighted all my strengths, weaknesses, opportunities and threats pertaining to the nursing practices. According to the standards for practice specified by the Nursing Council, the very first principle to e followed if to respect the individuality and dignity of all the health consumers. Treating with respect means interacting with the consumers in a polite and considerate manner, thereby helping them cope with their deteriorated condition and enable quick recovery. It is important to understand the cultural needs as well and decide upon the course of treatment accordingly. All the registered nurses are expected to work in partnerships as this enhances the working capability and also builds trust among the members of the staff, leaving no scope of discrimination. Another perception of working in partnerships can be with respect to the health consumers. It is important to listen to them, respond to their concerns and acknowledge their preferences as well . It is not necessary to give affirmation to all their preferences but only to those which are practicable. Also, it the responsibility of the nurse to encourage and motivate the consumers by providing them relevant and complete information about their condition, so that they can make decisions independently. Another point to be kept in mind is to respect and allow patientââ¬â¢s privacy and confidentiality. The code of conduct should comprise of integrity so that the consumerââ¬â¢s trust can be justified. Integrity means consistency in the principles and ethics that you follow and not abusing the position held by you or the trust of the authorities. Lastly, all the registered nurses must maintain public confidence and trust in their profession and also maintain the ethics involved (Nursing Counsil, 2011).
